Retain the EMIR exemption for risk mitigating derivatives

The European Securities and Markets Authority (ESMA) plans to abolish the hedging exemption for derivatives transactions in the real economy.

This would have negative consequences for financing and risk management in the industrial sector. Every regulation that limits the effectiveness of hedging simultaneously increases the risks for the economy and the financial markets. The BDI and other business associations have submitted a joint position paper on this issue. The associations strongly advocate retaining the hedging exemption for non-financial companies.
